ACCIDENT BENEFITS GUIDE

What If I Do Not Have A Motor Vehicle Insurance Policy?
If you do not personally have a motor vehicle insurance policy, you are entitled to make an Accident Benefits claim from the insurer of the other party involved in the motor vehicle accident. If there is no insurance available, you may be able to advance a claim to the Ontario Government’s Motor Vehicle Accident Fund, which provides Accident Benefits in uninsured circumstances. What Are Accident Benefits?
Statutory Accident Benefits (also known as “No Fault Benefits”) are benefits provided to persons in Ontario who become injured as a result of the use or operation of a motor vehicle. This includes vehicle occupants, pedestrians, or bicyclists. Some of the principal benefits include:
- Medical & Rehabilitation Benefits: For minor injuries, up to $3,500 for treatment. For non-minor injuries, up to $50,000. For catastrophic injuries, up to $1,000,000. These limits are inclusive of assessments and/or examinations
- Income Replacement Benefits: 70% of your gross income to a maximum of $400 per week.
- Non-Earner Benefits: Up to $185 per week if you are unemployed and suffer a complete inability to carry on a normal life as the result of injuries sustained in an accident. These benefits are not payable during the first six months following the accident.
