ACCIDENT BENEFITS GUIDE

Filing an insurance claim can be an overwhelming experience. Pace Law provides its clients with the experience and knowledge necessary to proceed through the process of applying and/or recovering damages and benefits by preparing and filing the required documentation, as well as the required supporting materials.

It is essential for accident victims to have knowledgeable and experienced representation in order to secure the benefits to which they are entitled. When filing a disability claim, there is a chance you may be denied the resources and help you need by your insurance company. Due to the existing tiered structure of Accident Benefits, victims’ access to rehabilitation support and treatment can be significantly limited.

What If I Do Not Have A Motor Vehicle Insurance Policy?

If you do not personally have a motor vehicle insurance policy, you are entitled to make an Accident Benefits claim from the insurer of the other party involved in the motor vehicle accident. If there is no insurance available, you may be able to advance a claim to the Ontario Government’s Motor Vehicle Accident Fund, which provides Accident Benefits in uninsured circumstances. Speak to a Pace Law Firm insurance claim lawyer in Toronto to find out what is the best way for you to advance your claim.

What Are Accident Benefits?

Statutory Accident Benefits (also known as “No Fault Benefits”) are benefits provided to persons in Ontario who become injured as a result of the use or operation of a motor vehicle. This includes vehicle occupants, pedestrians, or bicyclists. Some of the principal benefits include:

  • Medical & Rehabilitation Benefits: For minor injuries, up to $3,500 for treatment. For non-minor injuries, up to $50,000. For catastrophic injuries, up to $1,000,000. These limits are inclusive of assessments and/or examinations
  • Income Replacement Benefits: 70% of your gross income to a maximum of $400 per week.
  • Non-Earner Benefits: Up to $185 per week if you are unemployed and suffer a complete inability to carry on a normal life as the result of injuries sustained in an accident. These benefits are not payable during the first six months following the accident.
