We approach each file in terms of its own merits, and we are willing to negotiate terms that are satisfactory to all parties involved. Our goal is to provide counsel which brings together our skills with those of our partners in providing clients with efficient and effective representation.

Commercial Dispute Resolution

Our team of commercial lawyers provides strategic legal support by representing professionals, entrepreneurs, and businesses in analyzing and assessing various types of business disputes. Our experience—which includes both negotiating settlements, as well as taking matters to trial—allows us to provide our clients with informed and insightful opinions regarding their options in resolving disputes. In those cases that are both complex and lengthy, clients often face difficult decisions regarding the allocation of resources. Our team supports our clients in making informed decisions by detailing the legal status of the action, while also providing a substantive overview of the likely range of costs and timelines involved.

  • Partnering with Other Lawyers

We assist other lawyers and firms who need support in addressing commercial litigation matters. Our team is available to work with lawyers whose areas of practice do not include commercial law, but whose clients require representation in addressing commercial legal matters. In addition, we partner with lawyers who have taken on commercial litigation files that impose demands beyond their resources, and who require specific assistance in either resolving their case or bringing it to trial. In such instances, our team can provide the legal experience, resources, and support that sole practitioners or small firms may lack, thereby allowing for more effective and efficient representation. Our team’s significant trial experience represents a most valuable asset to lawyers confronted by the daunting challenges of conducting a trial.

  • Limited Scope Retainer/Bundling

We can assist lawyers—under a limited scope retainer or bundling arrangement—by taking on specific aspects of their litigation workload. We approach each file in terms of its own merits and are willing to negotiate terms that are satisfactory to all parties involved. In addition to providing strategic support in assessing a file and furthering its progress, our team possesses the expertise to address a wide range of tasks: such as carrying out investigations, conducting research, preparing e-discovery materials, drafting documents, trial preparation (hard copy and electronic), and representation. In addition, we can prepare for and attend at the Court of Appeal. Our goal is to provide counsel which brings together our skills with those of our partners in providing clients with efficient and effective representation. Our services may further the interests of both the client and the carriage lawyer by making the action more manageable and affordable.

  • Navigating the Electronic Process

The recent development of electronic trials and artificial intelligence poses significant challenges to the entire legal profession, but particularly to those litigators who do not have extensive support staff and/or electronic infrastructure. During this transitional period, commercial litigators must adapt in a proactive and constructive manner to the dramatic changes in the dispute resolution and trial landscape. We are willing to join with other lawyers in meeting what might otherwise be onerous or even overwhelming burdens in managing the electronic process.

  • Professional Integrity

Our commercial litigation team recognizes the importance of other firms’ relationships with their clients and respects the integrity of those professional relationships. We will not interfere with your relationship to your client; our aim is to provide knowledgeable and experienced litigation support in assisting other lawyers.

Donald Fiske headshot

Biography

Donald R. Fiske joined Pace Law Firm in April, 2008, in order to establish and head the firm’s Civil and Commercial Litigation department. The team which he has assembled addresses a variety of issues relating to corporate recovery, insolvency, partnership disputes, construction litigation, civil fraud, wrongful act conspiracy, Aboriginal commercial claims, breach of contract and claims against the Crown.

Don is a graduate of Dalhousie Law School and was called to the Ontario bar in 1977. In 2007 he was called to the bar in British Columbia. Don established his own litigation firm in 1982 and, over the course of the next 26 years, he specialized in matters pertaining to corporate collections, complex debtor/creditor litigation, insolvency, bankruptcy, and construction litigation matters.

Don’s roster of clients has included multinational corporations representing the manufacturing, financial, and communications sectors. In addition, he has also acted on behalf of numerous small business owners and entrepreneurs regarding various types of civil litigation, with a particular emphasis on debtor/creditor disputes. Recently he has also represented First Nations people in commercial disputes and currently provides consulting services with respect to First Nations commercial issues for members at Akwesasne, near Cornwall, and Whitesand First Nation in Northern Ontario.

Don has received his accreditation as a Certified Specialist in Civil Litigation from the Law Society of Ontario. With over 40 years of experience in commercial litigation, he possesses a wealth of knowledge and expertise, with a proven record of success, on which he draws in offering clients his unique expertise. Don is frequently consulted by lawyers in other law firms to provide advice as to approach and strategy and also to assist in ongoing litigation. He has extensive experience as a trial lawyer and also has conducted appeals at the Ontario Court of Appeal.

Two lawyers who worked with Don on trial matters have obtained their Certified Specialist status in Civil Litigation and another lawyer who worked with him has appeared as lead Counsel at the Supreme Court of Canada. Don possesses a unique skill set and resources to aid other lawyers who may wish to make a referral as a result of a conflict, or are seeking assistance in proceeding with an action which may require a more experienced hand. He often works with other law firms in preparing for trial and will assist at trial, if called upon.

The Civil Litigation Department believes in the words of retired Justice Joseph W. Quinn that “Trial lawyers try cases. Trial lawyers who settle their cases are social workers”.
