Understand the Law for No-Fault Automobile Insurance

Ontario legislation limits your rights when it comes to suing for damages for injuries following a motor vehicle accident. This same legislation, however, also outlines a claimant’s mandatory benefits.

You may receive compensation for your injuries from two types of claims.

The system consists of the following two parts:

  1. Accident Benefits: A prescribed set of mandatory benefits that insurers must pay to injured parties, including “at fault” drivers, passengers in vehicles, and injured pedestrians.
  2. A set of conditions and criteria that must be met before you are entitled to receive damages for specific physical and psychological injuries. Legally, this is known as a “tort claim.”
