Donald R. Fiske joined Pace Law Firm in April, 2008, in order to establish and head the firm’s Civil and Commercial Litigation department. The team which he has assembled addresses a variety of issues pertaining to corporate recovery, as well as commercial litigation matters as varied as insolvency issues, partnership disputes, Indian Act claims, breach of contract, and estate resolutions.
Don graduated from Dalhousie Law School in 1975, and in March, 1977, he was called to the bar in Ontario. In May, 2007, he was called to the bar in British Columbia. Don established his own litigation firm in 1982 and, over the course of the next 26 years, he specialized in matters pertaining to corporate collections and complex debtor/creditor litigation, including issues involving bankruptcy and insolvency. Don also possesses many years of experience and a significant expertise addressing issues and actions involving the Construction Lien Act and construction litigation.
Don’s roster of clients has included several multinational corporations representing the manufacturing, financial, and communications sectors. In addition, he has also acted on behalf of numerous small business owners and entrepreneurs regarding various types of civil litigation, with a particular emphasis on debtor/creditor disputes.
Don has received his accreditation as a Certified Specialist in Civil Litigation from the Law Society of Upper Canada. With over 30 years of experience in debtor/creditor litigation, he possesses a wealth of knowledge and experience, with a record of proven success, on which he draws in offering clients his unique expertise. Don is an astute strategist who has an outstanding reputation for his ability to assess difficult commercial conflicts, and to provide his clients with creative, cost-effective, and efficient solutions. He is a firm believer in exercising due diligence to arrive at an informed and comprehensive perspective on the nature of the issues at hand, thereby allowing him to pursue practical and optimal solutions, on his clients’ behalf, in a timely and forthright manner. While Don emphasizes realizing cost-effective resolution of disputes, his civil litigation expertise also includes his extensive experience and success as a trial lawyer. As such, he has appeared before all levels of Court in Ontario.
Don and his team offer a unique skill set and resources to aid other lawyers who may wish to make a referral as a result of a conflict or who are seeking assistance regarding a matter which is outside of their practice’s focus. He is most sensitive to the issues that arise when representing another lawyer’s client and, as such, approaches such relationships with exemplary professional tact and respect for all parties involved.
